Terms of Use

1. General

1.1. Website Operator

The website available through the domain name https://profil.is and all subdomains, or sections ("Website") are operated by Corolla IT 021 doo ("Corolla IT").

These terms of use ("Terms") govern the access, browsing and use of the Website by its users ("User" or "Users", as applicable) as well as the services available on the Website and the enjoyment of the services derived thereof (the "Services").

Some Services may be subject to specific conditions or instructions that must be accepted by the User prior to the provision of the relevant Service. These specific conditions may be imposed by Corolla IT or by third parties. Such specific conditions shall apply in addition to these Terms and in case of conflict shall supersede the Terms. Accordingly the User must acknowledge to have read and accepted such specific conditions.

Regarding the collection and processing of personal data, the Privacy Policy shall apply.

1.2. Agreement to Terms

Any user who accesses the Website shall be a User. If the User does not agree with all or any of these Terms, the User must leave the Website immediately.

1.3. User Warranties

By agreeing to these Terms, the User warrants that:

• The User is of legal age and has read and understood the conditions set forth herein.
• In the event of entering into or purchasing the Service, the User has legal capacity to do so.
• The User assumes all obligations set forth herein.

1.4. Minors

The access and use of the Website and/or the purchase of the Services by minors require the consent of their parents, guardians or legal authorised representatives. Such persons shall be held liable for the acts carried out by the minors under their custody. Please contact us in case you wish to authorise a minor.

In the event that the User is accessing and using the Website and/or purchasing the Services on behalf of a third party, such as an employer or a company, the User represents and warrants to have obtained the express prior authorization from such third party in order to use the Services, or to have been granted power of legal representation for the purposes of using or entering into the Services.

1.5. Right to Modify

Corolla IT reserves the right to modify, at any time, the Services, the Website as well as any aspect of these Terms. Notwithstanding the foregoing, the transactions made by the User prior to such modifications will be honoured and performed as agreed.

3. Access to the Website and to the Services

3.1. Access Requirements

Access to the Website is free, except for the cost of connection through the telecommunications network supplied by the User's provider. Access to the Services may be subject to remuneration in the conditions stated below and in the Website from time to time. The access and use of the Website and the Services requires a computer or computer equipment as well as internet connection. Any expense in connection with such items is not included in the Services described herein in the Terms and shall be borne exclusively by the User.

3.2. Authentication

In order to use the Services, the User must sign in to his Gmail, Microsoft, LinkedIn (with their authentication mechanisms – currently OAuth2) or with his username and password by using a supported browser, granting the authorizations requested for Gmail, Microsoft or LinkedIn as they are necessary for the rendering of the Service (please see the Privacy Policy regarding the data to which Corolla IT access despite these authorizations).

Corolla IT is not a service of Google Inc., Microsoft or LinkedIn. Corolla IT and those companies are different unaffiliated companies; consequently, they do not represent each other.

3.3. Good Faith Use

The User undertakes to use the Services in good faith and not to use it negligently, for fraudulent purposes or in an unlawful manner. In addition, the User agrees not to take part in any conduct or action that could damage the image, interests or rights of the Services, other Users or of third parties.

3.4. User Responsibility

It is the User's responsibility to ensure prior to using the Services that the features of the Services meet the User's needs.

3.5. Fair Use

The Services are powered by third-party AI models whose cost to Corolla IT scales with usage. To keep the Services sustainable for everyone, each account is subject to a monthly fair-use ceiling on AI usage, measured in tokens (the units in which AI models bill) consumed per calendar month across the whole account, regardless of how many resumes or applications it holds:

These ceilings are set far above what ordinary use of the Services requires; a User building and tailoring resumes in the normal way is not expected to reach them. They exist to bound abuse and automated over-consumption, not to meter the Services, and they are not a feature of any plan.

Corolla IT does not currently block requests at the ceiling. If an account exceeds it, Corolla IT will contact the User before taking any action, and reserves the right to rate-limit or suspend the account only where usage is abusive or automated. Corolla IT may revise these figures; material reductions will be published on this page in advance.

4. Website and the Corolla IT Services Code of Conduct

4.1. Prohibited Uses

The User agrees to use the Website and the Services in accordance with law, moral principles and public order as well as the Terms. The User shall refrain from using the Website or the Services for illegal activities or purposes that may be considered a criminal offence against third parties as well as violating any applicable law.

The User agrees not to use the Services to:

• Submit or disseminate content or information that is racist, xenophobic, pornographic, and supportive of terrorism or may infringe human rights.
• Submit or disseminate software (virus or malware) that may damage computer systems of the internet service provider, its providers or any other internet user.
• Disseminate, transmit or provide third parties with any type of information, element or content that might constitute a violation of the fundamental rights and civil liberties contemplated in the Serbian Constitution and international treaties.
• Disseminate, transmit or provide third parties with any type of information, element or content that constitutes unlawful or unfair advertising.
• Transmit unsolicited or unauthorised advertisements, advertising material, "spam," "chain mails," "pyramid schemes" or any other form of solicitation, except in those areas (such as commercial spaces) that are exclusively intended for these purposes.
• Submit or disseminate any false, ambiguous or inaccurate information or content that is deceptive to its recipients.
• Impersonate other Users of the Website and the Services.
• Disseminate, transmit or provide third parties with any type of information, element or content that may constitute a breach of intellectual property rights, patents, brands or copyright held by the owner of the Website and the Services or third parties.
• Disseminate, transmit or provide third parties with any type of information, element or content deemed to be a violation of privacy or data protection laws.

4.2. Indemnification

The User agrees to indemnify and hold harmless Corolla IT against any claim, fine, penalty or sanction arising from the User's failure to comply with the aforementioned conditions of use. Corolla IT reserves the right to claim compensation for damages incurred.

5. External Content and Services Accessible Through the Website

5.1. Linked Sites

The Website may contain links, directories and search engines that enable the User to access third party websites and portals ("Linked Sites"). Linked Sites are operated by third parties and not controlled by Corolla IT. Should any User consider that a Linked Site contains unlawful or inappropriate content, he must inform Corolla IT of such circumstances.

5.2. No Endorsement

The inclusion of Linked Sites on the Website neither implies an agreement between Corolla IT and the owners of the Linked Sites nor implies the recommendation or endorsement of the Linked Sites and/or its content by Corolla IT.

5.3. No Liability for Linked Sites

Unless otherwise stated on the Website, Corolla IT is unaware of the content and services of the Linked Sites and, consequently, shall not be held liable for any damage caused to the User or third parties by the unlawfulness nature, quality, outdating, unavailability, error or futility of the Linked Sites.

6. Intellectual Property

6.1. Ownership

All intellectual property on the Website and the Corolla IT Service is owned by Corolla IT or its licensors, including, but not limited to, the intellectual property in texts, photographs, graphics, images, icons, technology, software, links and any other audiovisual or sound content as well as its graphic design and source code. Under no circumstance shall the rights of exploitation contemplated in the intellectual property regulations in force of the aforementioned content be deemed to have been assigned or licensed to the User.

6.2. Trademarks

The trademarks, trade names or distinctive signs of any class displayed on the Website are owned by Corolla IT or third parties. Under no circumstance shall their trademark rights be deemed to have been assigned or licensed to the User. Profilis® is a registered trademark owned by Corolla IT.

6.3. License Grant

In regards to the Profilis Resume Builder, Corolla IT only grants to the User a personal, worldwide, non-transferable, non-exclusive license for the duration of the Services. After the termination of the Services, no matter the cause, the User shall cease immediately using the Profilis Resume Builder and the Services.

6.4. Restrictions

The User is forbidden, either partially or fully, either copying, modifying, disassembling, taking any action to derive the source code, creating derivative works or reverse engineering the Profilis Resume Builder and/or the Services.

7. Responsible Vulnerability Disclosure Policy

Any User interested in reporting security vulnerabilities to Corolla IT must abide by the Responsible Vulnerability Disclosure Policy. Please contact us at support@profil.is.

8. Purchase Terms of the Corolla IT Services

8.1. Paid Services

Certain features of the Services, as stated from time to time in the Website, may be subject to remuneration and to its purchase by the User.

Plans described as "unlimited" are intended for normal individual use and are subject to fair-use ceilings set far above it. These ceilings exist solely to prevent automated or abusive use and are not a rationing of the plan. If the User has a legitimate need beyond a ceiling, Corolla IT will raise it on request at support@profil.is.

8.2. Account Responsibility

The Services for Purchase shall be purchased for the account of the User involved in such process.

8.3. Prerequisites

In order to use the Service for Purchase, the User must previously have installed the free Service.

8.4. Payment Information

Additionally, the purchase process of Corolla IT requires the User to introduce its payment data and any other information necessary to effect payment.

8.5. Electronic Receipt

Corolla IT shall keep an electronic receipt of the User's purchase. Such receipt will not be available for the User.

9. Correction and Identification of Errors When Entering Data

9.1. Required Fields

Whenever the User does not fill out a required field, it will not be allowed to advance through the purchase process until such required field is filled out. A message will be displayed warning the User of such circumstances.

9.2. Account Updates

The User will be able, at any time, to modify and/or update his info as User of the Service by accessing the "Account" section.

9.3. Error Correction

In the event of non-rectifiable errors during the purchase process (for example, the purchase is made for the wrong email account), the User may request within 30 days the correction of such errors by sending a communication at support@profil.is.

10. Pricing and Term of the Corolla IT Service

The pricing and the terms of the different Corolla IT Services subscription modalities are provided in the Website and displayed on the screen prior to the purchase process when selecting a modality of subscription.

11. Refunds

Purchases made on the Website are sold and processed by Dodo Payments, Inc. acting as Corolla IT's merchant of record. Dodo Payments, and not Corolla IT, is the seller of record for those transactions, and refunds for them are issued by Dodo Payments and are additionally governed by the Dodo Payments Buyer Terms.

Purchases made on the Website are eligible for a full refund within 30 days from the purchase. To such extent, the User shall contact Corolla IT through support@profil.is, and Corolla IT will raise the request with Dodo Payments.

Purchases made in the Profilis iOS application are billed by Apple, and refunds for them are handled by Apple under Apple's policies. The 30-day refund set out above does not apply to them, and Corolla IT is unable to issue refunds for, or cancel, subscriptions purchased through Apple.

The Refund Policy sets out the full procedure, including how to contact Dodo Payments directly, and applies in addition to this section.

12. Support

In case of doubt regarding the Services, the User may contact Corolla IT by sending an email at support@profil.is.

13. Limitation of Liability

13.1. Service Limitations

The Service is one of the most reliable and accurate AI-powered resume builders available, and we continuously work to enhance it. However, like any technology, it has certain limitations.

There are two main causes of inaccuracy:

1. Uploaded resumes could contain information not related to the resume itself: For example, if the uploaded file includes extraneous notes, comments, or formatting errors such as duplicated text or irrelevant information like cover letters or portfolio items, the AI may misinterpret the data and produce a resume that does not accurately reflect the user's experience or qualifications. It is important to ensure that only relevant and clean resume data is uploaded to achieve the best results.

2. AI Hallucination: Another limitation of the Service is that, as with many AI technologies, there may be instances where the AI generates inaccurate or irrelevant information, a phenomenon known as "AI hallucination." This can occur when the AI misinterprets the input data or attempts to fill in gaps with incorrect details, leading to an inaccurate resume. While we continually work to improve the system, users should carefully review the generated resumes to ensure accuracy and completeness.

13.2. User Responsibility

The User acknowledges and accepts that the use of the Website and the Service is at the User's own risk and under the User's responsibility and therefore Corolla IT does not accept any responsibility for misuse or use in breach of these Terms.

The User will be responsible for any damages to Corolla IT resulting from the User's use of the Website, and the Service in breach of the Terms.

13.3. No Warranty

Corolla IT does not warrant the availability or continuity of the Website, or the Service, its accuracy, reliability or completeness, or whether they are fit for a particular purpose. To the maximum extent permitted by applicable law, Corolla IT will not have any liability in this regard.

As way of example and without limitation, Corolla IT shall not be liable for any damages that may result from:

• Interruptions, viruses, technical problems, interferences, omissions, unavailability, power cuts, failure of telecommunication networks or the User's equipment which are not Corolla IT's responsibility.
• Delays or unavailability of the Website, and the Service due to deficiencies or track overload on the Internet, in the communication network or the electricity grid.
• Third party actions.
• Unavailability of the Website, and the Service due to maintenance or software updates.
• Anything which is beyond Corolla IT's direct control.

13.4. Limitation

SAVE FOR COROLLA IT'S WILFUL MISCONDUCT, AND THOSE CASES IN WHICH DUE TO THE SPECIFIC CIRCUMSTANCES OF THE USER INVOLVED OR THE NATURE OF THE MATTER, APPLICABLE LAW PROVIDES THAT LIABILITY CANNOT BE LIMITED BY AGREEMENT, USE OF THE WEBSITE, AND THE SERVICE IS AT THE USER'S SOLE RISK AND COROLLA IT SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND CAUSED TO THE USER AS A RESULT OF USING THE WEBSITE, OR THE SERVICES.

14. Notices

14.1. Communication Requirements

All notices, requests, demands, and other communications between Corolla IT and the User in connection with the Service or access to the Website shall be in writing and shall be deemed to have been duly delivered if sent by certified mail to the address which the parties have indicated to the other to that effect.

14.2. Notices to Corolla IT

Notwithstanding the foregoing, notices sent to Corolla IT shall be deemed to have been duly made when sent by means of email at support@profil.is.

14.3. Notices to User

On the other hand, notices sent to the User shall be deemed to have been duly made when sent by means of email at the address associated with the User's email account as of the start of the Corolla IT Service use or, if required, the one that the User had provided Corolla IT with to that effect.

15. Severability

In the event that any provision of these Terms were to be found, whether partially or fully, to be null or void, such invalidity shall only affect the provision or section considered to be void or unenforceable. The remaining provisions of these Terms shall continue in full force. The invalid provision, whether partially or fully, shall be considered as not included in these Terms.

16. Choice of Law and Place of Conclusion of the Contract

16.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Serbia.

16.2. Jurisdiction

The purchase of the Corolla IT Service shall be considered to have been formalised on the place where Corolla IT's registered offices are located at the moment of purchase.

The User and Corolla IT expressly waive any other jurisdiction that may correspond to them and agree to resolve any controversy arising out of the Services or access to the Website before the Courts of Novi Sad (Serbia), except when the applicable law necessarily imposes otherwise.
